Criminal History Record Check for Surgical Technologist and Surgical Assistant Registrations
Legislation passed in 2016 requires surgical assistants and surgical technologists undergo a criminal history record check (CHRC) in connection with their Colorado registration. The new law went into effect on August 10, 2016. Below are some key facts we want to provide to interested stakeholders as we work together to implement this new law.
All applications received on or after August 10, 2016, will be required to have a CHRC.
Currently registered SAs and STs are encouraged to begin the CHRC process immediately to complete the CHRC process no later than October 31, 2016. The Director will be auditing current registrants to verify whether a CHRC was completed prior to the renewal of registrations.
New applications will not be processed without the criminal history record check.
Fingerprints must be taken by a qualified law enforcement agency (examples are included below).
The cost of the fingerprint and criminal history record check will be the responsibility of the individual applicant or SA/ST. All fees must be paid by certified check, money order or by completing and submitting a credit card authorization form at the time the fingerprints are taken and submitted to the Colorado Bureau of Investigation (CBI). The $39.50 CBI fingerprint processing fee is in addition to any fee(s) a law enforcement agency may charge to do the fingerprinting.
Once the CBI processes fingerprint submissions for background checks, it provides the results to the agency listed on the fingerprint card. According to state law, the results cannot be released/transferred by the CBI to any other organization that is not specifically listed on the fingerprint card.
The CHRC results are confidential. Only designated staff at the Office of Surgical Assistant and Surgical Technologist Registration will have access to the background check records.
